A man who broke his ankle in the stairway of a private members club has been awarded €95,000 by the High Court.

The man took a personal injury* claim against the company who own Residence, a private members club in Dublin. The Court was told that the man was leaving the piano bar on the second floor of Residence Club, when he slipped on a step of the staircase.

He claimed that the owners of Residence were negligent and in breach of their duty for failing to highlight the hazard caused by the staircase. He also claimed that the carpet which had been fitted to the stairs which was unsafe in the circumstance.

The personal injuries suffered by the man as a result of the accident were outlined in detail to the Court and in particular, Justice Mary Irvine commented that the man had suffered two significant injuries to his right leg and a metal plate had to be inserted. The Judge commented that he was completely disabled for many months as a result of the accident and suffered a lot of discomfort. The Judge awarded him €65,000 damages for pain and suffering to date and a further €30,000 for pain and suffering in to the future.
